It is now 9 am Sun 21 Jan 07 time is running out for the hearing (72hrs) and tomorrow I have to go for physiotherapy in Mumbles for my shoulder, but it is my fingers which are giving me the problem. So I am going to try and get everything down that is of relevance to my case and then hope I will have time to correct mistakes ( spelling etc) and then get it organised.

I started work in July 2001, my first day off sick, was in Nov 2004, and that was for stress induced by KP

Dec 2004
On the advice of  a few of my working colleagues I finally bring a complaint of bullying and harrasment against my supervisor KP.
...a lot of info to be inserted here..........WAIT..
I was not happy about the outcome, and realised it was pointless pursuing it. so I had to carry on working under his supervision.
It was obvious he was going to try and make things difficult for me.
The classic, was when he got me to power wash the Florence Asher site in Clydach

Nov 2005
After  about 10 months of trying, KP realises that I am not going to resign, so he makes an allegation that I threatened him, which brought a look of bemusement to a few of my colleagues, (KP is twice my size and about half my age and pumps muscle in the gym)
So I end up in a disciplinary with DD and the personnel officer, KP's statement said that he had a witness  (his best mate KR ) who was 5 yards away. Which is true.
I was in the back of the van when I was alleged to have threatened KP, So KR must have realised that it was not possible to hear anything from 5 yds, so he wisely wrote in his statement that he was 5 Feet away!
 
The morning of the disciplinary I e mailed DD and Personnel, a copy of Flasher at Florence Asher, to put them in the picture.
 Surprisingly I was found guilty and sent into exile in Carmarthenshire.
I did not bother to appeal because I did not place much hope on the decision being overturned (after the previous experience) and I was happy enough, to have a break from the Swansea area .
A few weeks later (Mon, 21 Nov 2005 10:02:36) I emailed personnel  to check that my previous document about Florence Asher had been received.
The Result
 Personnel said yes, but advised me, that the matter should be dealt with, in a team meeting?
We have had team meeting every 6 weeks
Personnel did not know that I had brought the matter up in the previous team meeting, but had been told by DD if I had any complaints I should put it in writing.
I waited for the next team meeting but we have not had a team meeting since!!!!
FIFTEEN MONTHS have gone by
My colleagues have often joked, "There will be no team meeting until Brian retires or gets sacked."

17/06/05     Leave lost as a result of non compliance with leave procedures. (this was the first I knew that I had lost leave
What is the bad thing I had done?

I had 6 days of leave left to take before the end of  the year (May 31).
KP asked, could I carry them over to the next year as we were short of staff due to sickness etc. I agreed.
A few days later I had RS on the phone to me. I must take the carried over leave, in June 05.
Why? I asked, I may want to take them in June but why do I have to. I am helping out. I am doing FHA a favor.
It is in the Policies and Procedures he said. I told him I will check. I did not bother phoning RS back.
I sent an email toST via Personnel

Dear Stuart.
  Regarding the text I received off you, asking for a holiday form
 for the 2 days I had verbally requested. I did not request 2 days.

  I verbally requested, the 6 that are due. But was told that due to
illness of staff etc, it was difficult to allow me the days I requested.

As I appreciate the problems, I agreed, as long as I could have
Wed 25 May my birthday and Tue 31 May, an own site day, that would not effect
the team rota.

This was agreed. Then I was told, that I must take the 4 days left, during
June!
I queried this, was it in our "Policies and Procedures", that carried
 over holidays, must be taken in June? If they were, what page is it on?

"I will get back to you,when I check," I was then told.
In the meantime I checked the policies myself, and all I could find was:

   "Holidays can only be carried over, only in extenuating circumstances
   and must have the approval of the Director of the Department".

I have no extenuating circumstances, so I cannot request for holidays to
be carried over.
Therefore I have to take my holidays in the only remaining 6 days left in
this year,
ie 23 May to 31 May.

But, if you can e-mail me today, (ie. "in writing"), confirming that the
Director of the Department is requesting, that I carry the 4 days into the
next year, to help the team, I will happily agree.

I have received this e-mail from Caroline this morning. I must remind you
that in requesting Annual leave you must comply with the Association's policies
& procedures at all times. If you are unclear as to the procedure, please
contact Darrin or Personnel who may assist in this regard.

I just gave up trying to get some sanity from senior staff so I worked the four days holidays to help the team,  never believing,
I would be punished for it, by losing 4 days holls!

Caretakers meeting  held on Friday 1st march 2002
Darrin Davies reported that mobile phones are to be provided for all caretakers.The current landline allowance will be terminated from 1st April..
From this date caretakers may make mobile calls equivalant to the value of the landline allowance.

I am the only caretaker left in employment, from that meeting.
I am allowed approximately £12 a month personnel calls.
In 54 months of use, management have only sent me two months itemised bills, where they think I have exceeded the £12 personal allowance
They wanted me to itemise the personal calls and pay the excess.
 The simple solution would have been to pick out a few calls at random and sent a cheque for say £5.42!
But I have principles, I asked for the other 52 months of  bills to see if FHA owe me money, because I am not normally a heavy user of the phone.
I also stated that the Aug bill was higher due to the new issue phone dialing in my pocket! There were 72p of texts to myself!
There were repeat (longer) calls to numbers seconds after I had made a short call.
This has been rectified by one of  my workmates programming the phone to lock automatically after a few seconds.

Start and finishing times.  Place of Work
When I started my employment with FHA I was picked up in the van at Exchange Court,where I was resident caretaker) at about 8.10am (during the waiting time I would be checking the building) by the van driver and was dropped off again at about 3,30pm (then I had to phone in, that I was home.
When I  became the van driver I would leave Exchange at 8.am and return at about 3.45pm
The same timings applied, when I moved to Brickyard
In my first summer of employment, I had to drive in my own car every other week to join the Carm's team
I received mileage allowance for this traveling. As I was resident caretaker of Exchange my place of work.
When I was sent to work in Carm's not much changed, I was picked up from Brickyard  where I was resident Caretaker by the other two caretakers (who lived in Swansea but their place of work was Pontardulais) and returned to Brickyard.
But during the early summer of 2006 things changed.
Of the two caretakers one resigned (due to the attitude of the supervisor and the other moved to live nr Ammanford.
I then had to travel to Pontardulais by 8am  and leave there at 3.30pm and when I put in my mileage claim. I was told that I was not eligible because my place of work is Pontardulais?.
Of the 12 caretakers employed by FHA I was the only one who not only had to go to work and return from work, in his own time.
                                           I also had to pay to go to work.
All the others travel in the works van.
Oct 2006 I was in the ludicrous situation , where I traveled to Pontardulais on the bus to pick up the van, because the supervisor (van driver) was on holiday. I then drove the van around the sites to work and then return the van and catch the bus home.
